Mobile Food Vendors: Texas Department of State Health Services to take over Permitting July 1, 2026!

From the Department of State Health Services Website- 

On May 26, 2025, the Texas Legislature passed House Bill 2844 (HB 2844), concerning the regulation of Mobile Food Vendors in Texas. The bill was signed into law by Gov. Abbott on June 10, 2025.  The effective date is July 1, 2026. DSHS and our local partners are charged with implementation of the requirements in such a way as to avoid an interruption of permitting and inspection services.  Our mission of ensuring a safe retail food supply to the citizens of Texas continues despite the difficulties presented by HB 2844. What this means for Vendors permitted in Unincorporated Guadalupe County. - The Guadalupe county Fire Marshals Permitting Department will continue to permit Mobile Food Vendors until July 1, 2026. 

What you need to do before July 1, 2026. - There are several major requirements that must be met BEFORE you can receive a permit from DSHS. Go to the the Texas Department of State Health Services webpage Permitting Information-Retail Food Establishments to review the requirements and find resources to assist you.


Permit & Inspection Process Overview

(This applies to the unincorporated areas of Guadalupe County.)

The Guadalupe Commissioner’s Court has adopted the International Fire Code, 2024 edition (IFC),as the Guadalupe County Fire Code (CFC). The court also adopted amendments to the IFC. The amendments and court order adopting the CFC are available on-line for review. The fees associated with each of the permit types can be found in the “Schedule of Fees”, on-line.
